These Terms and Conditions govern your purchase and use of the Baxoptimized Course. By completing checkout, you agree to be bound by them in full.

1.

Definitions

"Baxoptimized", "I", "me", or "my"refers to Baxter Hanley, sole trader, trading as Baxoptimized (ABN 43 943 532 568), based in the Illawarra region, NSW, Australia. The Baxoptimized Course is a product offered by the same business that provides Baxoptimized's web design and digital marketing services at baxoptimized.com.au — it is not a separate legal entity.

"Course" refers to the Baxoptimized Course: the video modules, written materials, checklists, templates and any bonus content made available to enrolled Students.

"Student", "you", or "your" refers to the individual who purchases and is enrolled in the Course.

"Materials" refers to all video, text, code samples, templates, checklists and other content provided as part of the Course.

The Course

The Course is a self-paced digital training product teaching a website design and build workflow. It is delivered online and Students access it at their own pace.

Lifetime access. Once enrolled, you retain access to the Course for as long as it remains available, including any future updates to the Materials, at no extra cost.

Baxoptimized may update, expand or restructure the Materials over time. Reasonable efforts will be made to preserve access to previously published content, but specific lessons, templates or tools referenced in the Course may change or be replaced, including where a third-party tool the Course relies on changes its own product or pricing.

3.

Enrolment and Payment

The Course is purchased through Baxoptimized's Stripe checkout. The price may be displayed in other currencies (e.g. USD) for convenience, but the amount actually charged is the amount shown by Stripe at checkout, exclusive of GST. Baxoptimized is not currently registered for GST.

Where a payment plan is offered at checkout, each instalment is a binding commitment. Access to the Course may be paused if a scheduled instalment fails and is not resolved within a reasonable time.

4.

Licence to Use Course Materials

On payment, you receive a personal, non-exclusive, non-transferable licence to access and use the Materials for your own learning and for building websites, including websites you sell to your own clients as part of your own business.

This licence does not permit you to:

  • Share your login, or the Materials themselves, with anyone who has not personally enrolled;
  • Republish, resell, redistribute, or use the Materials to create a competing course or training product;
  • Claim authorship of the Course content itself (as distinct from the websites you personally build using it, which are yours).

Baxoptimized may revoke access for a breach of this licence.

5.

Refund Policy

Baxoptimized offers a 30-day money-back guarantee. If, within 30 days of your enrolment date, you do not have a real site you're proud of, email hello@baxoptimized.com.au and you will receive a full refund of the amount paid. No form, no reason required, no conditions beyond the 30-day window.

Refunds are processed to the original payment method within a reasonable time of the request being received. Requests made after the 30-day window are considered at Baxoptimized's discretion.

Nothing in this section limits any consumer guarantee under the Australian Consumer Law that cannot be excluded, restricted or modified by agreement (see Section 10).

6.

No Guaranteed Outcomes

The Course teaches a skill and a workflow. Baxoptimized does not guarantee that you will earn any particular amount of income, secure any particular number of clients, or achieve any specific financial result from completing the Course. Any results referenced in Course marketing, testimonials, or Student stories reflect individual circumstances and effort and are not representative of a typical or expected outcome.

What is guaranteed is described in Section 5 above: a real, working website built by you by the end of the Course, or a full refund.

7.

Intellectual Property

Baxoptimized retains all intellectual property rights in the Course Materials — the video content, written lessons, templates, and the specific way the workflow is taught and structured.

You own the websites, code, and content you personally create while completing the Course, subject to the licence terms of any third-party tools, frameworks, or assets used in building them.

8.

Websites You Build During the Course

Any website you design, build, or sell to a third party (including your own paying clients) using skills or templates learned in the Course is your own work and your own responsibility. Baxoptimized is not a party to any arrangement between you and your own clients, has no visibility into what you build or sell, and is not liable for any claim, dispute, loss, or regulatory issue arising from a website you build or a client relationship you enter into after completing the Course.

9.

Third-Party Services

Course delivery and payment involve third-party platforms, including Stripe (payment processing) and the course hosting platform used to deliver video and written content. These services are subject to their own terms and Baxoptimized is not liable for any outage, data loss, or service interruption caused by a third-party platform.

10.

Limitation of Liability

To the maximum extent permitted by law, Baxoptimized's total liability to you arising out of or in connection with the Course is limited to the amount you paid for the Course.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

11.

Access and Conduct

Baxoptimized may suspend or terminate a Student's access to the Course in the event of a breach of the licence terms in Section 4, fraudulent payment, or abusive conduct towards Baxoptimized or other Students.

12.

Privacy

Baxoptimized's handling of your personal information in connection with the Course is described in the Privacy Policy, which forms part of these Terms.

13.

General Provisions

These Terms, together with the checkout page you completed, constitute the entire agreement between you and Baxoptimized in relation to the Course. If any provision is found invalid or unenforceable, the remaining provisions continue in full force. These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of its courts.

Acceptance

By completing checkout for the Baxoptimized Course, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in full.
